GRAPEVINE GATHERING TERMS AND CONDITIONS – VICTORIAN EVENT

The terms and conditions set out below (Terms and Conditions) constitute a binding contract between Grapevine Gathering National Pty Ltd (ACN 624 469 432) of801 Glenferrie Road, Hawthorn VIC 3122  (Promoter)and the person holding or using a ticket to the event Grapevine Gathering (Event) at Rochford Wines, 878 – 880 Maroondah Highway, ColdstreamVIC 3770 (Venue) irrespective of whether the ticket was purchased by the person holding or using the ticket and applies to any subsequent holders or recipients of the ticket (you or your).

Terms and Conditions are binding

Tickets to the Event (Event Ticket/s) are sold or given and admission to the Event is granted on the express condition that you agree to bound by these Terms and Conditions, the Privacy Policy available on (PrivacyPolicy) and any other rules and regulations issued by the Promoter available on www.grapevinegathering.com.au applicable to the Event, displayed at theEvent, communicated by the Promoter from time to time in any other format in connection with the Event (including via email and social media), the terms and conditions of any ticket merchant through which tickets to the Event are sold or distributed and any terms and conditions imposed by the Venue (Event Terms).

The Event Terms also apply as relevant to any bus transfer service organised by the Promoter to/from theEvent (Bus Service) and any ticket for the Bus Service (Bus Ticket)shall also be considered an Event Ticket for the purposes of these Event Terms except where expressly excluded or context indicates otherwise.

BY PURCHASING AN EVENT TICKET, YOU ACKNOWLEDGE THAT YOU UNDERSTAND THE EVENT TERMS AND AGREE THAT YOU WILL BE BOUND BY THOSE EVENT TERMS AS AMENDED FROM TIME TO TIME.

Event Site & VIP Areas

You must have a validEvent Ticket to enter the area designated at the Venue by the Promoter as the site for the Event (Event Site) and you must have a valid Event Ticket with VIP area access to access the area or areas designated by the Promoter as the VIP area or areas, if any (VIP Areas).

Compliance with Laws and Directions

You must follow all reasonable directions of the Promoter and any of its directors, officers,employees, personnel, agents, contractors, sub-contractors and employees, andany Venue staff (Event Staff),including but not limited to security, bar and traffic management personnel anddirections conveyed on signage at the Event Site and Venue, and comply with allapplicable laws (including regulations) at all times directly before, during,and directly after the Event (including but not limited to liquor licensing, smokinglaws and regulations and complying with total fire ban requirements).

The Promoter may authoriseor instruct, in its absolute discretion, Event Staff to carry out or performany of the obligations or functions of the Promoter in connection with theEvent.

In the case of anemergency or serious injury, you must follow all official directions of orauthorised by the Promoter, security staff and emergency services personnel.

Whilst awaiting entry to the Event, attendingthe Event and exiting the Event, you agree to comply with any physicaldistancing orders or other health orders in force at the time of the Event forthe purposes of preventing the spread of COVID-19 and any reasonable directionsor instructions given by the Promoter in relation to the same.

 

Minimum Age + Refusal of entry or evictionfrom Event

You must be aged 18 years or over to attend theEvent. You must providecurrent and valid photographic identification documents being either anAustralian driver’s licence, a Victorian learner’s permit, a Victorian proof ofage card or an equivalent from another state or territory of Australia, aKeypass card or an Australian or foreign passport to the satisfaction of the Promoterand/or Event Staff to verify that you are aged 18 years or over (Valid PhotoID) and may be required to provide Valid Photo ID at various times duringthe Event.

The Promoter reserves theright to, and to authorise or instruct Event Staff to, refuse entry or evictany person from the Event Site that: fails to comply with the Event Terms; isunder the age of 18; is unable to provide Valid Photo ID; appears to be unwellor is showing symptoms (including mild presentations) of a contagious disease;refuses to be searched or is in possession of any Prohibited Item; engages inany illegal activity or behaviour or any activity or behaviour deemed in the Promoter’sabsolute discretion to be unsafe, disorderly or antisocial, including, but notlimited to being intoxicated or affected by alcohol or drugs; crowd surfing,moshing or stage diving; entering non-public or designated no access areas ofthe Event Site or areas of the Event Site to which yourEvent Ticket does not permit access; climbing the staging, rigging or otherstructures at the Event Site; causing damage to property or goods at the EventSite; or acting in a violent, threatening, inappropriate, abusive, aggressive,sexist, racist or discriminatory manner or for any other reason in thePromoter’s absolute discretion.  

COVID-19 EntryConditions

EntryRequirements

You acknowledge that thereis currently a respiratory illness outbreak caused by a novel coronavirus(COVID-19). By attending the Event and entering the Event Site, you warrantthat:

(1)  You do nothave COVID-19, and are not awaiting test results for COVID-19 or otherwise havereason to suspect that you have contracted COVID-19; 

(2)  You have notknowingly been in contact with a person who: has tested positive for COVID-19in the last fourteen (14) days or has reason to believe they have contractedCOVID-19;

(3)  You have notreturned from international travel or a COVID-19 hot spot within Australia inthe last fourteen (14) days;

(4)  You are notexperiencing any of the following symptoms (Potential COVID-19 Symptoms):

                             i.    a cough

                            ii.    fever

                          iii.    shortness of breath

                          iv.    sore throat

                           v.    sneezing and runny nose

                          vi.    muscle or joint pains

                         vii.    nausea, diarrhoea, or vomiting

                        viii.    temporary loss of smell or taste, alteredsense of taste

                          ix.    loss of appetite and fatigue

                           x.    any other symptoms associated or linked withCOVID-19.

If you cannot make the warranties above, you must not attend the Event.

ContactTracing

You acknowledge that as a condition of yourentry, Promoter and third-parties may collect personal information for thepurposes of contact tracing and complying with COVID-19 related legislation,regulations and health orders (as amended from time to time). You agree andacknowledge that any personal information provided to any third-party ticketingintermediary (including Festicket) or the Promoter may be collected, used orheld by the Promoter or any third-party for this purpose. The Promoter willhold this information in accordance with Privacy Act 1988 (Cth), itsprivacy policy and any applicable government regulations or health order.

 

You acknowledge that as a condition of yourentry to the Event, you may also be required by the Promoter, Venue, or EventStaff, to submit contact tracing information to the Venue, Promoter or agovernment authority directly through an authorised mobile application or webcheck-in service (Check-In Tool). If you use a Check-In Tool, yourdisclosure of personal information will be governed by the terms of theoperator responsible for the Check-In Tool. The Promoter disclaims allliability in connection with your use of a Check-In Tool.

 

You warrant that any personal informationprovided by you to any third-party or the Promoter for the purpose of contacttracing is correct.

 

Event Tickets 

The Promoter uses thirdparties (including Festicket) an intermediaries to sell Event Tickets. No otherthird party is authorised to sell Event Tickets. Ticket sales may be subject tothe terms and conditions of these third parties (including as to paymentmethods and charges), and you are solely responsible for paying any and allbooking fees and charges in connection with the sale, including but not limitedto transaction and processing fees, such as credit card fees (which for theavoidance of doubt are additional to the advertised ticket price).

The Promoter reserves theright to enforce any published limit on the number of Event Tickets that can bepurchased by any one person and may cancel any Event Tickets obtained abovesuch limit by any one person.

Entry to the Event Sitewill be granted upon presentation of a barcoded Event Ticket (other than a BusTicket) and Valid Photo ID (see above) and subject to the other entryrequirements set out in these Terms and Conditions. Your Event Ticket (otherthan a Bus Ticket) must be presented upon arriving at the Event Site where it maybe exchanged for a wristband. The wristband must be worn at all times while youare at the Event Site.

Event Tickets andwristbands must be treated like cash. Event Tickets or wristbands that arelost, stolen, destroyed or damaged will not be refunded or replaced, except asrequired by law or where the Event Terms provide otherwise. Wristbands that havebeen removed, tampered with, given to a person other than the Event Ticketholder at the time of entry to the Event Site, damaged or defaced will berendered invalid and will not be replaced and there shall be no entitlement toa refund. Any person found without a wristband may be evicted from the EventSite by the Promoter or Event Staff.

You are responsible forchecking all Event information and ensuring you have purchased the correct EventTicket/s for the Event.

Event Tickets will haveyour name printed on them or will be otherwise registered to your name. Uponentry to the Event Site, Event Staff will check to ensure the name on your ValidPhoto ID matches the name on, or registered to, your Event Ticket. If the nameon, or registered to, your Event Ticket does not match the name on your ValidPhoto ID, your Event Ticket will be invalid and you will be refused entry tothe Event. The name on your Event Ticket, or the name to which your EventTicket is registered, may be changed by contacting the Promoter’s ticket resalemerchant Festicket via [INSERT] (or any other method required by Festicket)subject to payment by you of any applicable fees charged by the ticketingmerchant.

Any complimentary EventTickets provided by the Promoter may not, without the prior written consent of thePromoter, be sold, transferred or used by anyone other than the person whosename is on the Event Ticket or to which the Event Ticket is registered.

Unless otherwise providedfor in these Event Terms or required by law, Event Tickets are not exchangeableor redeemable for any other event, or any other consideration, monetary orotherwise.

Ticket Resale Restrictions

Event Tickets may only beresold by you via Tixel.

Event Tickets may not,without the prior written consent of Promoter, be re-sold or offered for resalevia any other means including by any other third-party (including Viagogo), ata premium (including via online auction sites) or used for advertising,promotion or other commercial purposes (including but not limited tocompetitions and trade promotions) or to enhance the demand for other goods orservices, either by the original purchaser or any subsequent bearer. If anEvent Ticket is sold or offered for re-­sale or used in breach of thiscondition, the Event Ticket may be cancelled without a refund and the holder ofthe Event Ticket may be refused admission or evicted from the Event.

Search on entry to Event Site

It is a condition of entryto the Event Site that a search of you and/or your possessions be conducted atthe time of entry to the Event Site and at other times if requested by thePromoter or Event Staff. This may include, but is not limited to, bag checks,vehicle searches, pat downs, metal detector tests and drug detection tests. Ifyou do not consent to such searches, you may be denied entry to the Event Site,or evicted from the Event Site. 

Prohibited Items

The Promoter and EventStaff may confiscate any Prohibited Items or any other items which thePromoter, in its absolute discretion, considers may be used in an illegal,unsafe, antisocial or offensive manner. Confiscated items will not be returned,replaced or reimbursed and proceeds from confiscated items (if any) will bedonated to a charity or charities of the Promoter’s choice. If You are found inpossession of any Prohibited Item, you may be refused entry or evicted from theEvent.  

The following items areprohibited and must not be brought into the Event Site (Prohibited Items):

·      Glass of anykind (including bottles and jars)

·      Alcohol

·      Illegal orillicit substances, drug paraphernalia

·      Eskies orflasks

·      Aerosol cans

·      Weapons of anysort including tasers and pepper spray

·      Items capableof being used as a projectile

·      Baseball bats andcricket bats or any similar item or equipment

·      Animals(excluding service dogs such as guide dogs subject to the Promoter’s priorapproval)

·      Flares,fireworks, sparklers or fire twirling equipment

·      Air horns,whistles, horns or musical instruments

·      Drums

·      Drones

·      BBQs, gasbottles and butane (or other compressed gas) cannisters or cylinders

·      Fires and openflames of any kind

·      Flammableitems

·      Flags orbanners

·      Explosives

·      Speakers orother sound amplifiers

·      Portable laserpens/equipment

·      Couches, armchairsor other furniture

·      Umbrellas,tents

·      Studdedclothing, footwear or accessories

·      Large bags(i.e. bags over the size of an A4 piece of paper (30cm x 20 cm))

·      Audio or videorecording devices (other than a mobile phone) or selfie sticks

·      Professionalphotography equipment (e.g. telephoto lenses; any lens over 20cm; anydetachable lens or anything deemed by the Promoter to be professionalphotography equipment)

·      Skateboards,scooters, rollerblades, roller-skates, bicycles, motorised vehicles or similar

·      Political, religious, offensiveor race-related materials; club patches or jackets

·      Any otherdangerous, unsafe, illegal or offensive items.

If you have any medical ormobility equipment necessary for your health and mobility that may otherwise beconsidered a Prohibited Item, please bring this to the attention of thePromoter or Event Staff prior to entry to the Event.

Smoking Policy

The Promoter may makeavailable designated smoking areas in their sole discretion. Smoking is onlypermitted in designated smoking areas. Any person found smoking at the Event(other than in a designated smoking area) may be evicted from the Event.

Photographingand/or recording of the Event

Personal digital camerasare permitted at the Event. Single-lens reflex (SLR) and digital single-lensreflex (DSLR) cameras are permitted at the Event Site, but professionalphotography equipment (including, but not limited to telephoto lenses, any lensover 20cm or any detachable lens) is not permitted at the Event without mediaaccreditation issued by the Promoter. The Promoter shall determine in its absolutediscretion, whether photography equipment is considered to be professional photographyequipment. Photos of artists, musicians and/or the Event are permitted only onthe basis that:

  1. images are only used for private and     personal use; and
  2. images cannot be made available for sale     and/or public display.

Recording or filming theEvent is strictly prohibited. The Promoter reserves the right to confiscateand/or delete any footage, recordings and/or photographs created byunauthorised or prohibited recording, filming or photography.

Recording andPhotographing of the Event by Promoter

You consent to be includedin any audio recordings, audio-visual recordings and photographs of the Eventcreated by, at the direction of, or with the authority of the Promoter (Materials). In the event that you holdany rights in the Materials, without any fee or compensation payable to you,you irrevocably assign to the Promoter any and all benefit, right, title andinterest in and to the Materials owned, controlled or created by you for thePromoter to hold and exploit in any context in any and all media now known orlater devised absolutely, in perpetuity, throughout the world (including foradvertising, marketing and promotional purposes whether in respect of thePromoter or third parties), free from any claims whatsoever from you. You irrevocably waive allmoral or other similar rights in respect of your performance or participationin the Materials that you may be entitled to under the laws of any jurisdictionthroughout the world in perpetuity. To the extent that the foregoing waiver isnot enforceable in any such jurisdiction, you unconditionally and irrevocablyconsent, for the benefit of everyone throughout the world, to the Promoter, itslicensees and assignees doing or authorising the doing of any act or making orauthorising the making of any omission which may infringe your moral rights inrespect of the Materials.

Restricted Capacity Areas

You acknowledge that the Promoter may set restrictions on the number ofpeople that can attend certain areas of the Event Site, such as withinbuildings or structures, within enclosed areas or at stages (Restricted Capacity Areas) includingfor health and safety reasons or to comply with COVID-19 related restrictionsor orders. Once the maximum capacity, as determined by the Promoter, at anyRestricted Capacity Area has been reached, the Promoter or Event Staff mayprevent further admissions to the Restricted Capacity Areas. Your purchase ofan Event Ticket does not guarantee admission to Restricted Capacity Areas wherethe maximum capacity has been reached and you will not be entitled to a refund ifyou are prevented from entering a Restricted Capacity Area. If you attempt toenter or enter a Restricted Capacity Area where you are not permitted to do so,you may be evicted from the Event.

Bus Service

Purchase of a Bus Ticket will entitle you to access the Bus Service asdescribed on the Bus Ticket and otherwise indicated by the Promoter. Youacknowledge that purchase or possession of a Bus Ticket does not entitle you toentry to the Venue. You also acknowledge that in the event you are not at thepick-up location for the Bus Service, the relevant bus service may departwithout you and if such occurs, you will not be entitled to a refund ortransfer in respect of any portion of the Bus Ticket. You acknowledge that theEvent Terms (where relevant) apply equally to your access to the Bus Service.

COVID-19Restrictions at the Event

You mustsocially distance and stay 1.5 metres away from other Event attendees and EventStaff wherever possible and wear a face mask where social distancing is notpossible. You will be permitted to wear a face mask during the Event but willneed to remove the mask to confirm your identity at entry to the Venue, whenpurchasing alcohol and when otherwise requested by Event Staff. You shouldinform Event Staff immediately if you feel that your, or someone else’s health,is threatened. If you begin to develop Potential COVID-19 Symptoms (howevermild), please immediately inform Event Staff.

Alcohol

The Event is fullylicensed. You must not bring alcohol into the Event Site. Only alcoholpurchased from bars at the Event may be consumed at the Event Site. You must beaged 18 years or over to purchase and/or consume alcohol on the Event Site and you must provide Valid Photo ID inorder to purchase alcohol. If you are found supplying or buying alcohol for anyperson under 18 years of age you will be evicted from the Event Site and thePromoter may report your conduct to the police.

Food and non-alcoholicdrinks

Food and non-alcoholicdrinks will be permitted into the Event Site. The contents of any unsealedbottles will not be permitted into the Event Site, but unsealed empty plasticbottles (no glass) are permitted into the Event Site for filling with water atthe Event Site. Cooking facilities will not be provided at the Event Site.

Cashless Event

The Event may be cash free.The Promoter and Venue reserve the right to designate card as the only acceptedform of payment at any point of sale at and in the Event.

Drugs andillegal substances

If you are foundsupplying, consuming or in possession of illicit drugs or illegal substances bythe Promoter or Event Staff, you shall be evicted from the Event Site and thePromoter may notify the Police.

Signage

You are not permitted todisplay any trading signs at the Event Site without prior written consent ofPromoter.

Clothing, footwear and ear plugs

Appropriate clothing and footwearmust be worn at all times at the Event Site. Any person wearing high heels,studded clothing, or other clothing items which pose a safety threat or mayotherwise cause offense, in the Promoters’ sole discretion, may be refusedentry or evicted from the Event.

Due to the noise levels atthe Event Site, you should wear ear plugs at all appropriate times during theEvent.

Movement around the Event Site

You must take reasonable care when moving around, or traversing, theEvent Site. You must move (whether on foot or in a vehicle) in an orderlyfashion, in accordance with the directions of the Promoter and Event Staff, andyou must not do anything that may hinder, or prevent, the safe passage of otherpatrons or Event Staff at the Event Site or the surrounding areas (includingentering and exiting the Event Site). Where maps of the Event Site are madeavailable by the Promoter, you should familiarise yourself with the layout ofthe Event Site, including the location of any emergency exits, to assist withmoving around the Event Site safely in the event of an emergency.

Promoter will endeavour tomake the Event Site accessible for those using wheelchairs, mobility scootersor with a disability; however you acknowledge that the Venue has pre-existingnatural terrain and pre-existing structures and facilities, and in some casesit may be impossible, impractical, unsafe or contrary to building laws orregulations to make all areas of the Event Site accessible for all patrons. Bypurchasing an Event Ticket, you acknowledge and understand that some publicareas of the Venue may not be accessible by all patrons. Injury or illness

In the event of injury orillness the Promoter or Event Staff may, at your expense, arrange medicaltreatment and/or emergency evacuation as deemed necessary or advisable (in theopinion of the Promoter or Event Staff) for your health or safety or for the healthand safety of other persons at the Event.

If, at any time during theEvent, you experience any Potential COVID-19 Symptoms, you will immediatelyreport to Event Staff and follow any reasonable directions given by Event Staffor other health professional. You acknowledge and agree that you may be evictedfrom the Event.

Environmentand facilities

Please be respectful ofthe environment and place any litter in the recycle or other bins providedaround the Event Site. When you need to use the toilet, you must only use thepublic toilet facilities provided at the Event Site. You must not damage,improperly use or tamper with any public facility or infrastructure at theEvent Site, or intentionally or recklessly cause any damage or interference toplants or animals at the Event Site or in the area surrounding the Event Site.

Your belongings

You enter the Event Siteat your own risk and shall be responsible for the safety and security of allyour belongings brought into the Event Site. The Promoter accepts noresponsibility for any loss, damage or theft of or to your possessions orproperty at the Event including where a coat check service is available.

Event Siteaccess

There shall be no entry intothe Event Site prior to 12:00pmlocal time at the Event Site on [insert date] and the Event Site must be vacated by [insert time] local timeat the Event Site on [insertdate].

Weatherconditions

The Event is an allweather event and will take place rain, hail or shine (unless the Promoterdetermines otherwise in its absolute discretion). You should be prepared forall weather conditions. The geographical area in which the Event is situated maybe subject to extremes of temperatures.

Swimming NotPermitted

Inthe event that there are any rivers, lakes, streams, water courses, dams, poolsor any other bodies of water at or around the Event Site, swimming is notpermitted.

Leaving the EventSite

There are no pass-outs orre-entries for the Event for any reason whatsoever. Once you leave the Venue,you will not be permitted to re-enter.

At the conclusion of theEvent, you must remove all of your belongings, rubbish, recycling and vehicles.The Promoter will not be responsible for any of your property left at the EventSite and the Promoter may discard, sell or donate to charity any property leftat the Event Site following the conclusion of the Event.

After leaving the Event Site,you warrant that you will comply with any legislation, regulation, health orderor government recommendation in place for the purposes of preventing the spreadof COVID-19.

Alterations tothe Event

To the extent permitted bylaw and subject to these Event Terms, the Promoter reserves the right tochange, add, withdraw or substitute artists in the Event line-up, vary theadvertised program, the date, the entry and exit times, the amenities, thefacilities, the attractions, the entertainment, the Event Site and/or the VIPAreas for the Event at its discretion without prior notification. Youacknowledge that the Promoter does not make any representations or warrantiesin respect of the aforementioned factors, and you have not relied on anyrepresentations or warranties by the Promoter regarding the above in connectionwith your purchase of an Event Ticket.

The Event is provided ‘asis’ and to the extent permittable by law, the Promoter makes no warranties orrepresentations regarding the suitability of the Event, and any photos of pastevents used in connection with the promotion and marketing of the Event areillustrative only and should not be relied upon as an accurate description ofthe Event.

Without limiting theforegoing, you agree and acknowledge that the Promoter may need to makesignificant changes to the Event in response to COVID-19 and to comply with anylegislation, regulation, health order or other government direction orrecommendation in place to prevent the spread of COVID-19 and that thesechanges may occur after you purchase your Event Ticket, at any time prior tothe Event. These restrictions may include seating or dancing arrangements,format of the event (including location and visibility of the stages orscreens), creation of restricted zones within the Venue. You agree andacknowledge that except where required by law, you will not be entitled to arefund in these circumstances.

If the Promoter determinesthat a reduction to the capacity of the Event is necessary or desirable, thefirst purchased Event Tickets will remain valid up to the revised Eventcapacity. Any other Event Tickets will automatically be transferred to the next‘Grapevine Gathering’ event but those ticket holders will be entitled torequest a refund in line with further information provided by the Promoter atsuch time.

Refund andCancellation Policy

The Promoter may deny admissionto the Event Site and/or VIP Areas (including admission to a particularperformance at the Event Site) in accordance with the Event Terms or otherwise inits absolute discretion.

Except where required bylaw or, there will be no refund of any Event Tickets or for any unused portionof an Event Ticket. This includes but is not limited to where there has been avariation to the Event, if you are refused entry to or evicted from the EventSite or VIP Areas by the Promoter or Event Staff in accordance with the EventTerms, if you fail or are unable to attend the Event, if you arrive after thecommencement of the Event, if you leave the Event Site prior to the conclusionof the Event, or if you purchase the incorrect type of Event Ticket.

If the Event is cancelled(in whole or in part) by the Promoter as a result of any act of God; extremeweather; bushfires; war; council or governmental rulings or decisions; actionsor decisions of the police or other authorities; cancellationby the Venue owner, lessee or controller; or for any reason outside of thePromoter’s reasonable control, refunds shall be in the Promoter’s sole andabsolute discretion unless otherwise required by law.

Release 

To the full extentpermitted by law, you waive all legal rights of action against and fullyrelease the Promoter; Event Staff; the owners, lessees and controllers of theVenue and Event Site; and the respective members, directors, officers,employees, volunteers, contractors or agents of the aforementioned (Released Parties) from any liabilityfor any loss, damage, personal injury, death, economic loss or consequentialloss suffered or incurred howsoever arising in any way out of (A) theperformance or non-performance by Promoter of any part or whole of these EventTerms (including any liability under contract or tort) or (B) your purchase ofan Event Ticket and/or attendance at the Event; including but not limited to(i) damage to your or any other person’s computer or device resulting frompurchase of an Event Ticket (ii) any theft, loss or damage to your property(including motor vehicles) at the Event (iii) any variation to the Event asstated in these Event Terms; (iv) your choice to consume any alcoholicbeverages or participate in any activities at the Event; (v) any other loss ordamage caused by the your negligence or the unforeseeable actions of otherpatrons.

Indemnity

By purchasing an EventTicket, you agree to indemnify the Released Parties against any loss or damageany of them may suffer as a result of your wilful, negligent or reckless actsor omissions at the Event or as a result of your breach of the Event Terms.

Promoter’sLiability

To the extent permitted bylaw (including the Australian Consumer Law), the Released Parties will not beliable or responsible for any loss, damage, injury, delays, additional expensesor inconvenience suffered or incurred by you or any person in or entering orexiting the Event Site, participating in the Event or otherwise in connectionwith the Event whether caused by the negligence of Promoter or any of theReleased Parties and whether arising in tort, contract, bailment or otherwise.Where liability cannot be excluded or modified by law, the liability of theReleased Parties is limited to the minimum permitted by law. Where permittedunder the Australian Consumer Law (being Schedule 2 of the Competition andConsumer Act 2010 (Cth)) (Australian Consumer Law), the Promoterlimits its liability in respect of breach of any statutory guarantee under theAustralian Consumer Law in the manner set out in section 64A(2)(b) of theAustralian Consumer Law.  

VoluntaryAssumption of Risk

Entry to the Event Site isat your own risk. You understand that your attendance at the Event may carrywith it certain dangers, including the risk of injury and damage to you(including but limited to any injury or illness, or loss related to or causedby COVID-19) and your property. By attending the Event and entering the EventSite, you accept the risk of damage and loss (including property damage,personal injury, economic and consequential loss) howsoever arising (includingby negligence) at the Event.

Your PersonalInformation

Your personal informationwill be collected and handled in accordance with the Privacy Policy.

Variations toEvent Terms

TheseTerms and Conditions and/or any of the Event Terms may varied at any time bythe Promoter in its absolute discretion (to the extent permitted by law). Anyvariations become effective immediately once the variation is published,displayed or otherwise communicated.

Novation orAssignment

ThePromoter may novate or assign its rights and/or obligations under these Termsand Conditions. Where the assignee or novatee assumes the rights and/orobligations of the Promoter under these Terms and Conditions, the Promotershall be released from all such rights or obligations.

Severability

If any provision or partof a provision of these Terms and Conditions is held or found to be void,invalid or otherwise unenforceable, it will be deemed to be severed to theextent that it is void or to the extent of voidability, invalidity orunenforceability, but the remainder of that provision will remain in full forceand effect.

Governing law

These Terms and Conditionsshall be governed by and construed in accordance with the laws of Victoria andthe parties irrevocably and unconditionally submit to the jurisdiction of thecourts there.

Conditions of entry

By entering the event, you acknowledged and agree;

1. All conditions shown on the ticket are to be read together with all other statements or directives either shown on the ticket or displayed on the website or at the event.

2. It is a condition of the liquor license that only valid ticket holders are allowed to enter the event.

3. This is an 18 plus event, minors will not be permitted entry. All ticket holders must present ID on entry.

4. The event is a licensed event recommended for a mature audience.

5. Each patron attending the event must have their own valid ticket.

6. The event has the capacity to be very loud, have high intensity crowd movements, bands that may use profanities in their performance and patrons drinking alcohol.

7. Photo ID is required purchase alcohol regardless of your age. It is illegal to provide minors with alcohol and anyone caught doing so may be prosecuted and ejected.

8. This venue has wheelchair access and disabled amenities, please visit the event website for details.

9. Intoxicated patrons or patrons under the influence of drugs may not be admitted.

10. You may bring an empty water bottle for refilling during the day. Please drink water regularly.

11. No recording device of any kind is allowed except a hand-held digital camera or phone with a non-removable lens. Professional cameras of any kind are not allowed on site without authority from the Presenter.

12. It is a condition of sale that you agree that the Presenter reserves the right to refuse a ticket holder admission to the event or to evict that person from the event for any reason whatsoever at the Presenters absolute discretion.

13. Entry is at your own risk.

14. Your tickets should be treated as cash. Except as required by law, tickets will not be replaced, nor money refunded after purchase. The Presenter does not offer refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond the Presenters control.

15. Tickets bought from Non-official websites or other sources may be refused entry.

16. If the event is cancelled by the Presenter for any reason, only the face value of the ticket will be refunded. If Presenter deems it necessary to abandon the event due to the forces of nature or any other reason, refund of the face value of the ticket is at the discretion of the Presenter.

17. Crowd surfing, moshing, slam or circle dancing are all dangerous activities that can seriously injure other patrons and will not be tolerated.

18. Please note there are restricted capacities at some stages and other tented structures. Once the maximum capacity is reached in these areas there will be no further admissions. Your purchase of an event ticket does not guarantee admission to these areas in such cases.

19. Smoking areas are provided and must be used.

20. Except as provided by law, the Presenter and the owner and/or lessee of the venue shall not be held liable for any loss, injury or damages sustained entering or within the venue whether caused by the negligence of the Presenter or that owner or lessee or otherwise.

21. Ticket holders’ consent to filming and sound recording as members of the audience

22. No pass outs will be issued unless otherwise advised.

23. In the case of an emergency evacuation or situation, please follow all official directives from police security or event organisers.

24. All bags and containers are subject to a full search at entry to ensure the safety of patrons.

  1. Entry will be subject to all state government mandates & laws in regard to COVID-19, including the requirement to be double vaccinated against COVID-19. Proof of vaccination will be required.
  2. Refunds will not be offered for attendees who choose not to be vaccinated or will not be vaccinated in time to attend Grapevine Gathering.
